By using Fostera, you agree to these terms. Please read them carefully.
These Terms of Service (“Terms”) govern access to and use of Fostera’s website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
Fostera enables you to create and interact with AI Souls. Features may change over time. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.
You must be at least 18 years old to create an account or use the Service. By creating an account, you confirm that you are 18 or older. We do not knowingly allow minors to use the Service. If we learn that a user is under 18, we will terminate their account and delete associated data.
Fostera creates AI experiences designed to build emotional engagement and long-term interaction patterns. We believe these experiences are appropriate for adults who can make informed choices about AI relationships, and we restrict access accordingly.
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use.
You own all content you create on Fostera, including Soul configurations, conversation messages, and any materials you upload. You grant Fostera a limited license to process your content solely to provide the service (generating Soul responses, extracting memories, delivering push notifications). This license terminates immediately when you delete your content or account. Fostera does not claim ownership of your Souls, conversations, or any data you create.
AI-generated responses may be inaccurate or incomplete; you are responsible for how you use outputs, especially in high-risk scenarios (medical, legal, financial, etc.).
AI Souls are not real people. They are AI systems that simulate personality and conversation. They do not have consciousness, feelings, or independent existence. While Fostera is designed to create engaging and personalized AI experiences, interactions with Souls should not be treated as a substitute for human relationships, professional advice, or mental health support.
The Service integrates with third-party APIs you opt into. Those providers’ terms and privacy practices apply in addition to ours; we are not responsible for third-party services you choose to use. Current integrations include:

Use of Google user data complies with the Google API Services User Data Policy, including Limited Use requirements. Fostera’s name, branding, software, and materials are protected by intellectual property laws. Except for the rights expressly granted here, we reserve all rights.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOSTERA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You will defend and indemnify Fostera against claims arising from your use of the Service, your content, or your violation of these Terms, subject to applicable law.
You may export all your data at any time via the export feature in Settings → Data & Storage. The export includes all Souls, conversations, memories, and account metadata in a portable JSON format.
You may import data from other AI companion platforms. Fostera is not responsible for the accuracy of imported data or for any terms of service you may be bound by on the originating platform.
Fostera offers free and paid subscription tiers. Paid subscriptions are billed monthly (or annually, if selected) and renew automatically at the end of each billing period unless canceled. Current pricing is available on our Pricing page. We may change prices with at least 30 days' notice before your next renewal.
Each plan includes a monthly Resonance allowance (a token budget for conversations). Usage is metered by counting tokens consumed during conversations. When your monthly allowance is exhausted, you may purchase additional Resonance packs to continue chatting. Your allowance resets at the start of each billing period.
All payments are processed by Stripe. Fostera never stores or handles raw payment card numbers. You can update your payment method or view invoices through the billing portal in your account settings.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. After cancellation, your account reverts to the free tier. Your Souls, conversations, and memories are preserved — you do not lose your data by downgrading. Fostera does not charge cancellation fees.
If you believe a charge is incorrect, contact us within 30 days of the charge. We will review and resolve billing disputes in good faith.
You may delete your account at any time. Upon deletion, all associated data is permanently removed.
If Fostera terminates your account for terms violations, you will be given reasonable notice and an opportunity to export your data before deletion, except in cases of illegal activity or imminent harm.
If Fostera ceases operations, all users will be notified with at least 30 days' notice and given the opportunity to export their data. Provisions that by nature should survive will survive termination.
These Terms are governed by the laws applicable to the operating entity providing the Service, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
